Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by PoolLEAD Pro ("we," "us," or "our") via propoolleads.com (the "Service"), you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.

2. Subscription and Payment Terms

Recurring Billing: The Service is provided on a monthly, recurring subscription basis. By providing a payment method, you explicitly authorize PoolLEAD Pro to charge the monthly subscription fee to your payment method on file at the commencement of each billing cycle until you cancel your subscription.

Cancellation: You may cancel your subscription at any time via the Client Portal. Upon cancellation, your subscription will remain active until the end of the then-current billing term.

No Refunds: ALL FEES ARE NON-REFUNDABLE. This includes, but is not limited to, monthly membership fees, usage-based fees, and lead credits. No pro-rated refunds will be issued for cancellations made mid-term.

3. Email Account Integration and Liability

To utilize the Service's outbound communication features, you are required to connect your personal or business email accounts (e.g., Gmail, Outlook) via OAuth or other provided methods.

Zero Responsibility for Client Accounts: PoolLEAD Pro acts solely as an automation tool. We bear NO responsibility for the health, reputation, or status of your connected email accounts. You acknowledge that:

  • You grant us permission to read, write, send, and manage emails within your connected accounts.
  • You are the sole "Sender" for legal purposes (including CAN-SPAM and similar regulations).
  • We are not liable for any account suspensions, "spam" flagging, blacklisting, or terminations initiated by your email provider (Google, Microsoft, etc.).
  • We are not responsible for any data loss within your connected email accounts.

4. Non-Exclusivity

No Territorial Exclusivity: You acknowledge and agree that PoolLEAD Pro does not grant any form of exclusivity regarding "Splash Zones," geographic territories, or Lead data. The same Leads and geographic areas may be served to multiple clients simultaneously.

5. Lead Data Disclaimer

While we strive for accuracy, all lead data is provided "as-is" and "as-available." We make no guarantees, express or implied, regarding the accuracy, deliverability, or conversion rates of any leads generated or curated by the Service.

6. Prohibited Use

You may not use the Service for any unlawful purpose. You are prohibited from extracting, "scraping," or reselling the lead database provided by the Service for use outside of your own direct marketing efforts or for building a competing service.

7. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

8. Limitation of Liability

To the maximum extent permitted by law, PoolLEAD Pro shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.
